EQDemic School ICAS Assessments

2024 Terms and Conditions

 

INTRODUCTION

1.1. EQDemic School ("the School") is an authorised reseller of the ICAS Assessments 2024, a suite of Janison Solutions Pty Ltd ("Janison").

1.2. These Terms and Conditions apply to students and parents who register for the ICAS Assessments 2024 through the School's registration platform at https://www.eqdemic.com.au/icas.

REGISTRATION AND PAYMENT

2.1. Students must register for the ICAS Assessments 2024 through the School's online registration platform at https://www.eqdemic.com.au/icas.

2.2. Payment for the Assessments must be made at the time of registration, using the available payment methods listed on the registration platform.

 

ASSESSMENT DATES AND VENUES

3.1. The ICAS Assessments 2024 will take place on the dates specified on the School's registration platform at https://www.eqdemic.com.au/icas .

3.2. The Assessments will be held at EQDemic School or an alternative venue designated by the School. The exact location will be communicated to students and parents prior to the Assessments.

 

ASSESSMENT SAFETY AND RULES

4.1. Students must follow all safety guidelines and rules provided by the School during the Assessments, including wearing appropriate attire, observing COVID-19 safety measures (if applicable), and complying with the instructions of School staff and supervisors.

4.2. Students must not engage in any behavior that disrupts the Assessments or jeopardizes the safety of themselves or others. Failure to adhere to the safety guidelines and rules may result in disqualification from the Assessments and removal from the venue.

 

LIABILITY DISCLAIMER

5.1. The School will take reasonable precautions to ensure the safety of students during the Assessments. However, the School will not be liable for any injuries, damages, or losses resulting from participation in the Assessments, except as provided by law.

5.2. The School is not responsible for any personal belongings or valuables brought to the Assessments by students or parents. Students and parents are advised to keep their belongings secure at all times.

 

CANCELLATION AND REFUND POLICY

6.1. Refunds or credits for the Assessments may be issued at the School's discretion, based on individual circumstances. Requests for refunds or credits must be made in writing to the School.

6.2. The School reserves the right to cancel or reschedule an Assessment due to unforeseen circumstances. In such cases, registered students will be notified and given the option to reschedule or receive a refund.

6.3. If a student is unable to attend the Assessment due to illness or other extenuating circumstances, The School may, at its discretion, offer a refund or credit for the Assessment, provided that the student or their parent/guardian submits a written request accompanied by relevant supporting documentation, such as a medical certificate, to The School at info@eqdemic.com.au at least two weeks before the scheduled Assessment date.

6.4. No refunds or credits will be granted for students who fail to attend the Assessment without prior notice of at least two weeks, or for reasons not deemed valid by The School. Requests for cancellation and refunds made less than two weeks before the scheduled Assessment date will not be accepted.

6.5 CANCELLATION/TERMINATION BY JANISON

6.5.1 Janison are entitled to cancel your order if:

6.5.1.1 the product you have requested to purchase is no longer available;

6.5.1.2 there is an error in the description of the product listed; or

6.5.2 If your order is canceled by Janison, a refund will be issued to you.

COPYRIGHT AND INTELLECTUAL PROPERTY

7.1. All copyright and intellectual property rights in the Assessments are owned by Janison. Students, parents, and staff must not reproduce, distribute, or otherwise use any part of the Assessments without written permission from Janison.

7.2. The school , staff, students, and parents of The School must not produce, adapt, license, sell, re-sell, upload online, post, communicate, transmit, modify, distribute, publish or otherwise use, any part of the Product and Test Platform without written permission from Janison.

7.3. The school, staff, students and parents are not entitled to photograph, print, copy, duplicate or otherwise access the content of our tests which are protected by copyright and Janison’s Intellectual Property rights. Any attempt to do so may result in legal action against you.

7.4. Any breach of Janison’s Intellectual Property Rights may result in Janison claiming monetary damages or criminal charges against you.

7.5. You agree, on behalf of your child that any content provided to Janison (for example answers input by students responding to a question in an ICAS Assessment) (user generated content) may be used by Janison for its internal business purposes (for example in marking guides and training materials) to deliver and/or improve the Product and Services (purpose) and you provide Janison with a perpetual, royalty free, worldwide licence to copy, alter, distribute, perform and/or display the user generated content to third parties, affiliated organisations or other users for the purpose (Janison can use the user generated content for Janison’s purposes with no payment to you).

7.6. Display by Janison of the above user generated content will be de-identified (no name included). You agree that Janison may engage in actions or omissions that would, in the absence of your consent, amount to an infringement of moral rights.

 

CONFIDENTIALITY AND PRIVACY

8.1. Janison will collect, use, and disclose personal information in accordance with Janison's Privacy Policy and the Privacy Collection Statement is listed below:

8.2 Janison’s CONFIDENTIALITY AND PRIVACY

8.2.1. Janison will only collect Personal Information from you for the purpose of:

8.2.1.1. delivering the Product and Services to you;

8.2.1.2. to generate reports and analysis and to improve our Product and Services;

8.2.2. Any Personal Information you provide to us for the purposes of us delivering our Product to you will be held in Australia. In making a purchase of our Product, you consent to your Personal Information being held in Australia. We may utilise third party’s to assist us in delivering the Product and/or Services. Such third party’s may be located overseas, for further information please see the Janison Privacy Policy.

8.2.3. Any disclosure and collection of personal information will be in accordance with the Janison Privacy Policy and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

8.2.4. We may use de-identified and aggregated information provided for any business purpose, including sharing de-identified data with third party partners.

8.2.5. Occasionally we may generate case studies or reports to be used for marketing purposes. We will contact you for your permission if we would like to feature your child.

 

DISPUTE RESOLUTION

9.1. Any disputes arising from the Assessments or these Terms and Conditions should be addressed to the School in writing. The School will endeavor to resolve any disputes in a timely and fair manner.

 

AMENDMENTS TO TERMS AND CONDITIONS

10.1. The School reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on the School's registration platform at https://www.eqdemic.com.au/icas, and it is the responsibility of students and parents to review and abide by the updated Terms and Conditions.

 

GOVERNING LAW

11.1. These Terms and Conditions are governed by the laws of the state or territory in which the School is located, and any disputes will be subject to the jurisdiction of the courts in that state or territory.

12.2. HOW WE WILL COMMUNICATE WITH YOU

12.2.1. All our communication with you will be provided through the contact details you used when registering for your account.

12.2.2. You agree that we may contact you to:

  • share information, product, offers, events and news about ICAS and other Janison products and services; and

  • invite you to participate in research, marketing and promotional activities undertaken by us for our Product and Services.

12.2.3. You can request to opt out of receiving marketing and promotional communications from us at any time by using our unsubscribe facility in messages, or by emailing the School.

 

EXAMINATION SAFETY GUIDELINES

13.1. All students and accompanying individuals must follow the examination safety guidelines set forth by EQDemic School. These guidelines are in place to ensure a secure and comfortable testing environment for all participants.

13.2. Students and accompanying individuals are required to follow any instructions provided by EQDemic School staff, proctors, or other designated personnel during the examination process.

13.3. Students are prohibited from bringing any unauthorized materials, including but not limited to, electronic devices, notes, books, or other study aids into the examination area. Violation of this rule may result in disqualification from the ICAS Assessments 2024.

13.4. Students must not engage in any form of cheating or misconduct during the examination process. Any such behavior will be reported to the appropriate authorities, and may result in disqualification from the ICAS Assessments 2024 and possible further disciplinary action.

 

LIABILITY DISCLAIMER

14.1. EQDemic School will not be held responsible for any personal injury, property damage, or loss that may occur during the ICAS Assessments 2024, except in cases where such injury, damage, or loss is directly attributable to the negligence or misconduct of EQDemic School.

14.2. EQDemic School not be held liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the ICAS Assessments 2024, including but not limited to, any inability to participate in the examination, any disruption to the examination process, or any errors or omissions in the administration of the examination.

 

ACCEPTANCE OF TERMS AND CONDITIONS

15.1. By registering for and participating in the ICAS Assessments 2024, students and their parents or guardians acknowledge and agree to abide by these Terms and Conditions. Failure to comply with these Terms and Conditions may result in disqualification from the ICAS Assessments 2024.

 

FORCE MAJEURE

16.1. Neither EQDemic School nor Janison will be held responsible or liable for any delay, interruption, or failure in the performance of their obligations under these Terms and Conditions if such delay, interruption, or failure is due to a Force Majeure event. A Force Majeure event includes, but is not limited to, acts of God, war, terrorism, civil unrest, strikes, labor disputes, natural disasters, epidemics, pandemics, or any other event or circumstances beyond the reasonable control of EQDemic School or Janison.

SCHEDULE 1 – MEDALS ELIGIBILITY 

1.1 Students enrolled in all Registered Schools and who sit ICAS Assessments during the Sitting Period are eligible to compete for medals. 

1.2 Janison may award medals to a student who achieves a top score in their year level in their state or territory for the ICAS test, which Janison judges to be sufficiently meritorious. EQDemic School students are eligible to compete for an ICAS medals provided that the subjects offered at EQDemic School are not available at their own schools for their respective year levels.

1.3 To ensure the integrity of ICAS Assessments, we reserve the right to investigate any matter which we believe may have affected a student’s performance or eligibility for a medal. 

ATTACHMENT 1 – JANISON PRIVACY COLLECTION STATEMENT 

ICAS Assessment is owned by Janison Solutions Pty Ltd (We, Us, Our). 

To deliver assessment products, Janison will require your child’s School to obtain your consent to provide Janison with certain personal information of students. Janison will collect, store, use, disclose and otherwise deal with such personal information in accordance with its privacy policy (below). We are aware of our responsibility to protect personal information related to children and students from being disclosed when we deliver an ICAS Assessments product. Unless you, as the child’s legal guardian consents, we will not: 

 

  • collect any personal information or data of children other than the information we need for the successful completion of an assessment, test or exam; 

  • transfer any personal information we obtain from a child in the delivery of assessments and tests to any jurisdiction outside of Australia; 

  • share any personal information relating to children with any third parties (except for those third parties necessary for us to carry out our Services or provide our Products e.g. medal engraving); 

  • use any personal information or data relating to children for marketing purposes.

We may retain personal information and data relevant to a child for their future purposes or for research purposes by Janison for the duration of the school life-cycle of the child. However, if you or your child at any time wish to have their personal information or data removed from our systems, they or you may opt out by simply contacting our Privacy Officer at privacy@janison.com or by contacting icasassessments@janison.com 

ATTACHMENT 2 – EQDEMIC SCHOOL PRIVACY COLLECTION STATEMENT 

To deliver ICAS assessment products, EQDemic will require to obtain your consent to provide us with certain personal information of students. EQDemic School will collect, store, use, disclose and otherwise deal with such personal information in accordance with its privacy policy (below). We are aware of our responsibility to protect personal information related to children and students from being disclosed when we deliver an ICAS Assessments product. Unless you, as the child’s legal guardian consents, we will not: 

  • collect any personal information or data of children other than the information we need for the successful completion of an assessment, test or exam;

  • transfer any personal information we obtain from a child in the delivery of assessments and tests to any jurisdiction outside of Australia;

  • share any personal information relating to children with any third parties (except for those third parties necessary for us to carry out our Services or provide our Products);

  • use any personal information or data relating to children for marketing purposes.

We may retain personal information and data relevant to a child for their future purposes or for research purposes by EQDemic School for the duration of the school life-cycle of the child. However, if you or your child at any time wish to have their personal information or data removed from our systems, they or you may opt out by simply contacting our School Officer info@eqdemic.com.au.
